While we make reasonable efforts to ensure the information on this website is accurate and up to date, we make no warranties or guarantees regarding its accuracy, completeness, or suitability for any particular purpose.

Your use of any information or materials on this website is entirely at your own risk. We accept no liability for any loss or damage arising from your reliance on information found on this website, to the fullest extent permitted by law.

Part B: Client Terms & Conditions

The following terms apply to all clients and prospective clients of Emma Brooke Gilding Ltd’s counselling, psychotherapy, and coaching services. By booking a session or programme with us, you agree to these terms. These terms apply to all future bookings, whether made via our online system or by any other means.

6. Nature of Services

Emma Brooke Gilding Ltd provides integrative psychotherapeutic counselling and coaching services, as well as digital products including guided meditations, courses, and publications. All sessions are delivered online via secure, encrypted video platforms. Digital products are delivered electronically via our website or third-party platforms. Emma Brooke Gilding is based in Portugal and serves clients and customers internationally.

Our therapeutic and coaching services are not a substitute for psychiatric or medical treatment. Digital products are provided for personal development and educational purposes only. If you are in immediate crisis or danger, please contact your local emergency services.

7. Professional Registration and Insurance

Emma Brooke Gilding is a registered member of the National Counselling & Psychotherapy Society (NCPS) and adheres to the NCPS Code of Ethics. She holds professional liability insurance underwritten by Lloyd’s Insurance Company S.A.

8. Bookings and Session Duration

All sessions are 50 minutes unless otherwise stated. Bookings are made through our online booking system, powered by Practice Better.

Before your first session, you will be asked to complete a consultation form. This information is necessary for us to work with you safely and ethically, and will be retained in accordance with our Privacy Policy.

9. Fees and Payment

Session fees are published on our website and/or communicated to you at the time of booking. Payment is processed securely via Stripe, integrated through Practice Better.

Fees are reviewed regularly and are subject to change. If fees change, you will be given at least two months’ notice by email. You may then choose whether to continue or to work towards an agreed ending. If there has been a gap of six months or more since your last paid session, new sessions will be charged at the current prevailing rate.

10. Cancellations and Rescheduling

Individual sessions (not forming part of a package) cancelled with less than 48 hours’ notice will incur a charge of between 50% and 100% of the session fee, at our discretion. Where rescheduling is agreed, the rescheduled session must be taken within one calendar month; otherwise, the session is considered forfeited and the full fee remains due.

We reserve the right to charge the cancellation fee using the payment method you have on file with our payment processor.

11. Programmes and Packages

Once you have signed up to a programme, you enter into a contract to pay for the programme in full, regardless of whether or not you complete all sessions within it.

Emma Brooke Gilding Ltd reserves the right to amend or cancel any programme at any time. In such cases, a refund will be issued for any booked work not yet delivered.

Subscription packages (not including instalment plans for full programmes) may be cancelled at any time by emailing emma@emmabrooke.net. No refunds or partial refunds will be given for payments already made; the last payment taken will be the final payment.

12. Refunds

Refunds will not be given except as specifically stated in Section 11 above. Outcomes are never guaranteed.

13. Confidentiality

All information you share with Emma Brooke Gilding is treated as confidential. The circumstances in which confidentiality may be broken are set out in full in Section 9 of our Privacy Policy and include situations involving significant risk to your safety or the safety of others, legal requirements, and professional supervision.

Anonymised case material may occasionally be used for professional development, supervision, or academic assessment. If you would prefer this did not happen, please let us know in writing.

14. Health Disclosure

It is your responsibility to disclose fully and honestly, on your consultation form and throughout our work together, any relevant information about your physical and mental health, including any diagnosed conditions, medication, and whether you are currently under the care of a psychiatrist or other mental health professional.

This is not a barrier to working together — it is essential information that allows us to support you safely. Failure to disclose relevant health information may affect our ability to work with you and could impact the safety and effectiveness of our sessions.

It is vital to discuss medical conditions and medication before the commencement of any therapeutic work.

15. Client Responsibilities

By choosing to work with Emma Brooke Gilding Ltd, you agree to the following:

  • You will provide accurate contact details and emergency contact information, and update these promptly if they change.
  • You will attend all sessions free from the influence of alcohol or drugs, except prescribed medication that has been disclosed to us.
  • You will ensure that the location from which you attend sessions is safe, private, and free from distractions, and you will inform us if anyone else is present or able to overhear the session.
  • You will not record any session (audio or video) without prior written permission.
  • You understand and accept that sessions are conducted across international borders via online platforms, and that you are responsible for ensuring your participation complies with any laws applicable to you in your jurisdiction.

16. Our Rights

Emma Brooke Gilding Ltd reserves the right to:

  • Refuse to work with any person for any reason, including where we believe the services offered are not appropriate for your needs.
  • Terminate a session without notice if we have reason to believe the session has been booked for a purpose other than that stated. In such cases, the full session fee remains due.
  • End the therapeutic relationship where, in our professional judgement, it is no longer in your best interests to continue, or where the terms of this agreement are not being respected. In such circumstances, we will endeavour to provide an appropriate referral where possible.

17. Online and International Service Delivery

All services are delivered online. While we make every reasonable effort to ensure session continuity, we accept no liability for disruptions caused by technology failures, internet connectivity issues, or factors outside our control.

You acknowledge that our services are provided by a UK-registered company, delivered from Portugal. Time zones and scheduling are managed through our booking system. You are responsible for attending your session at the agreed time.

18. Informed Consent for Online Therapy

By engaging our services, you acknowledge and accept the following:

  • Advantages of online therapy may include convenience of scheduling, no travel required, the comfort of attending from your own environment, and greater accessibility for international clients.
  • Limitations of online therapy may include reduced non-verbal cues (as sessions are conducted via video), dependence on a stable internet connection, and the inherent limitations of digital confidentiality (though we use only fully encrypted platforms for live sessions).
  • All bookings, payments, session communications, and clinical notes are managed through Practice Better, which is fully encrypted. However, any communication via standard email, text message, or social media is not encrypted and is sent at your own risk.
  • Emma Brooke Gilding Ltd retains ownership of all therapeutic records, including session notes, messages within our client platform, and emails. You may not publish, share, or reproduce direct or verbatim information from sessions without our written consent.

19. Social Media and Professional Boundaries

To preserve the integrity of the therapeutic relationship and protect confidentiality, we will not accept or respond to friend requests, direct messages, @replies, blog comments, or any other social media interaction from clients. Any such communications will be disregarded. If you wish to contact us, please use email.

20. Intellectual Property

All materials provided to you in the course of our work — including but not limited to worksheets, resources, audio recordings, guided meditations, courses, publications, written content, and session notes — are the copyright of Emma Brooke Gilding Ltd. All rights are reserved. These materials are provided for your personal use only and may not be reproduced, shared, or distributed without our written consent.

Digital products purchased from us are licensed for your personal, non-commercial use only. Purchasing a digital product does not transfer any intellectual property rights to you. Sharing, reselling, or redistributing purchased digital products is prohibited.

21. Mutual Respect

Mutual respect is upheld throughout our work together. Bullying, harassment, abusive language, or threatening behaviour directed at Emma Brooke Gilding — whether during sessions or in any form of communication — will not be tolerated and may result in the immediate termination of the therapeutic relationship.

22. Liability and Disclaimer

Any suggestions, reflections, or resources offered during sessions or in writing are offered in good faith as part of a therapeutic or coaching process. They do not constitute medical advice and should not be treated as such. Any resources shared are used at your own risk.

Emma Brooke Gilding Ltd will not be held liable for any outcome or consequence arising from the therapeutic or coaching process, to the fullest extent permitted by law.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

23. Data Protection

We are committed to protecting your personal data. Full details of how we collect, use, store, and share your information are set out in our Privacy Policy, available at emmabrooke.net/privacy-policy.

We are registered with the Information Commissioner’s Office (ICO), registration number ZB541905. Your personal data will be retained for a minimum of ten (10) years from the date of your last session, in accordance with the requirements of our professional liability insurance.

24. Governing Law and Jurisdiction

These terms and conditions, and any dispute arising from them or from your use of our services, are governed by the laws of England and Wales.

This applies regardless of where you are located when accessing our services. By engaging our services, you agree to submit to the jurisdiction of the courts of England and Wales for the resolution of any dispute, while acknowledging that this does not affect any mandatory consumer protection rights you may have under the laws of your own country.

25. Changes to These Terms

We reserve the right to amend these terms and conditions at any time. When we do, we will update the “Last updated” date at the top of this page. Where changes are significant, we will notify existing clients by email. It is your responsibility to review this page periodically.

By continuing to use our services after any changes are published, you accept the updated terms.


Part C: My Journal App Terms

The following terms apply to all users of My Journal (myjournal.emmabrooke.net), a web-based journaling application operated by Emma Brooke Gilding Ltd. By creating an account or using the app, you agree to these terms in addition to the general website terms in Part A.

26. The Service

My Journal is a personal journaling application delivered as a progressive web app (PWA). It allows you to create, edit, and store journal entries using customisable templates, track personal habits and reflections, and export your data. The app is provided on a subscription basis following a free trial period.

27. Account Registration

To use My Journal, you must create an account using a valid email address and password. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately at emma@emmabrooke.net if you become aware of any unauthorised use of your account.

You must be at least 18 years of age to create an account.

28. Free Trial and Subscription

New users receive a 7-day free trial with full access to all features. Your payment card details are collected at registration to ensure continuity of service after the trial period.

After the trial, your subscription will automatically renew at the current rate (£1.50 per month at the time of writing) unless you cancel before the trial period ends. Subscription payments are processed by Stripe. We do not store your payment card details on our systems.

The subscription fee may change from time to time. We will notify you by email of any price change at least 30 days before it takes effect. If you do not wish to continue at the new price, you may cancel your subscription before the change takes effect.

29. Cancellation and Account Deletion

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period — you will retain access to the app until that date.

No refunds or partial refunds are given for the current billing period upon cancellation.

If you register an account but do not complete checkout to start a subscription, your account and any associated data will be automatically deleted 30 days after registration.

If you start a subscription and later cancel, your data (including all journal entries, templates, emoji data, and account information) will be retained for 30 days after the end of your paid subscription period, then automatically deleted. During this time, you may resubscribe to restore full access, or contact us to request a data export. After 30 days, your data cannot be recovered.

We recommend using the app’s built-in export tools (JSON and CSV) to download your data before your subscription ends.

30. Your Content

You retain full ownership of the journal entries and personal content you create within My Journal. We do not claim any intellectual property rights over your content.

Your content is private to your account. We do not access, read, review, or share your journal entries unless you specifically request our assistance or we are required to do so by law.

By using the app, you grant us a limited, non-exclusive licence to store, process, and display your content back to you solely for the purpose of providing the service. This licence terminates when your data is deleted.

31. App Intellectual Property

The My Journal application — including its design, code, default templates, icons, and all associated materials — is the copyright of Emma Brooke Gilding Ltd. All rights are reserved.

Certain content within the app is provided with permission from third parties (for example, the Forgiveness Letter template is shared with the kind permission of Jennifer Hadley of The Power of Love Ministry). Such content is identified within the app and remains the intellectual property of the respective rights holders.

You may not copy, reproduce, reverse-engineer, or distribute any part of the application or its default templates.

32. Acceptable Use

You agree not to use My Journal to store, transmit, or distribute any content that is unlawful, harmful, threatening, abusive, defamatory, or otherwise objectionable. We reserve the right to suspend or terminate your account if we become aware of any such use.

33. Availability and Liability

We aim to keep My Journal available at all times but do not guarantee uninterrupted access. The app may be temporarily unavailable due to maintenance, updates, or factors outside our control (including internet connectivity issues, hosting outages, or third-party service disruptions).

To the fullest extent permitted by law, Emma Brooke Gilding Ltd shall not be liable for any loss of data, loss of access, or any direct, indirect, incidental, or consequential loss or damage arising from your use of the app or any interruption to the service.

We strongly recommend that you regularly export your journal data using the built-in export tools as a personal backup.

34. Changes to the App

We may update, modify, or discontinue features of My Journal at any time. Where changes are significant (for example, the removal of a major feature or a change to pricing), we will notify users by email with reasonable notice.

35. Termination by Us

We reserve the right to suspend or terminate your account if you breach these terms, use the app in a way that could harm other users or the service, or if we are required to do so by law. In such cases, we will endeavour to give you reasonable notice and an opportunity to export your data, except where immediate action is necessary.
